Unable to bear any longer the expense of maintaining the castle [castellum] of Margatum and fearful that he can no longer hold it against enemies so close by, with the advice of Patriarch Aimery of Antioch and the agreement of Prince Bohemond, his wife domina Sibilla Antiochie principissa, his sons the milites Raimundus and Boamundus, Count Raymond III of Tripoli, dominus Anterius Valenie episcopus and many others - clerics, milites and burgenses - Bertrandus has given the city of Valenia, the castle [castellum] of Margatum and the castle [castellum] of Brahym, with villani, casalia and guastinae, together with the milites and men [homines] living there and holding fiefs [feodi et feodati], on the same terms as they were held by Bertrandus and his father Rainaudus. [Bohemond includes the charter of Bertrandus in full]. Bohemond excludes from the grant casale Assenem, which dominus Rainaldus gave him pro novesimo de se et hominibus suis; the houses of Bertrandus in Antioch, which he sold and gave away; an oven, which he gave to [the monks of] Jubinum; and the terra de Gereneis which the prince retains for himself, although he promises to give it to no other religious order than the Hospital and adds that if he should give it to a layman, it will be held in the Hospital’s lordship. Bohemond confirms the possession by the Hospital of the dependencies of the feodum Margati: Margatum, Cademois, Laycas,Malaicas/ Malaycas, Bokebeis, casale Belne, and in the principality of Antioch, casale Fassia with its guastinae and dependences by land and sea, casale Cimas, abbatia Montis Parlerii, the villa called Russa, casale Farangum, casale Coma, castellum Popos with its casale, casale Kaynon, casale Alus, abbatia S. Gregorii, which is in Montana Nigra with its casalia and guastinae, Rogia with its guastinae, casale Belmesyn, casale Besselemon, casale Luzin, cavea Belmys, casale Casnapor, casale Colcas, casale Corconai and Meunsarac which are in the mountains of Mons Parlerius, Potama and Pangeregan which are in the Vallis Russa, Andesin, abbatia de sancta Maria, casale Bodoleie, half of the casale called Gorrosie, casale Mastabe. Possession of these, with milites, homines and villani [feodi et feodati] and all rights is confirmed as an eleemosynary grant, to benefit especially the soul of Bohemond’s father Raymond. The Hospital of St John is to hold all this freed from any servitium. Bohemond confirms everything that dominus Rainaldus had in Antioch, including a bath house, and [the lordship of] all the milites of the castrum of Margatum with the servitii and feodi previously owed to dominus Rainaldus Masoerius and dominus Bertrandus. The Hospitallers may retain all loot taken from the enemy. They are not bound to observe truces made by Bohemond with the Saraceni. If they make truces with the enemies who are in the feudum of Bokebeis or are before Gabulum, Bohemond will observe them if notified. The Hospitallers are free to bring in or take out, sell or buy their goods throughout the whole of the principality without payment of any exaction, but if their homines sell or buy goods that are not the property of the Hospital, the accustomed duty [consuetudo] will be payable to the prince’s curia. If any of the prince’s subjects [homines], who are franci, give any burgesia, the Hospitallers may sell it after holding it for a year and a day, provided it is not a holding that owes servicium, but they cannot acquire any feudum held by a miles or cliens without the prince’s permission. If any of the prince’s villani, whether Saraceni or homines, enter the territories of Valenia or Margatum or other holdings, the Hospitallers should return them according to law and custom [iuxta assisiam et consuetudinem terre], but they may retain Christians and those who make peace with the prince. The prince will act similarly with respect to villani of the Hospital. In return for the prince’s alms-gift the magister and the brothers of the Hospital have given Bohemond out of charity 8000 Saracen besants and have given his sons Raimundus and Boemundus 1000 Saracen besants each. Conradus marchionis Montisferrati filius records under seal that he has confirmed for the Pisans of the societas Vermiliorum, who were in the city of Acre, all their houses, a bath house, an oven, the church of St Peter and all the empty land between the funda regis and the Gate of Jofredus Tortus in Acre. The land stretches [on one side] along the public way that runs in a straight line by the funda regis to the gate of the city near the cemetery and on the other as far as the sea. Conradus has also given: [a rent of] 2000 besants to be drawn each year from the funda and catena of Acre in the instalments established for assisia; outside Acre a water mill [molendinum aque] near the city, together with a good garden; in the region of Acre, casale Sancti Georgii, which had belonged to Henricus Bufalus, and Castellum Novum Regis, which had belonged to comes Iozelinus. These grants are made with the freedom to treat them in the Pisanorum curia or establish their boundaries as the societas wishes. They are freed from all talia, tributum and servicium, because of the service already rendered in the defence of Christianity and Tyre. Guy, per dei gratiam in sancta civitate Iherusalem Latinorum rex VIIIus, and his wife Queen Sibylla confirm under seal for the Pisan commune its possession of land in Acre with houses, churches, ovens, a bath house and all buildings established between Caput Furoris as far as the door of [the church of] St Andrew and outside the door as far as the tarsana, the sea and the cathena, and on the other side from the water of the port as far as shore of the burgus novus along the road [via] that runs from the Caput Furoris, past the house of Guidotta in a straight line as far as the shore of the burgus novus and as far as the commandery [domus] of the Knights Templar, saving the rights of the Templars, the Hospitallers and the church of St Anne. Guy and Sibylla also give the commune of the Pisans all the houses it possesses in the burgus novus and in any other part of Acre; in the neighbourhood of the city, Cabor, a garden which belonged to Antelmus, and a second mill on the river of Acre, which is next to the Gate/church [partem] [225] of St Nicholas. They concede to the Pisans and their commune in Acre the right to use weights and measures [statera et pensae et modia et mensurae] for wine and oil and all other things in sales to other persons. They also confirm for the commune of the Pisans in Acre freedom of entry into and departure from the kingdom of Jerusalem by land and sea, and a free curia. All Pisans and those leased houses by them, whether scapuli, burgenses, milites, comiti or of any lay condition whatever, should be judged in the Pisan curia, except for cases involving feoda or assisiae, which should be judged in the curiae of the lords [domni]. Otherwise no Pisan shall be subject to the jurisdiction of the royal curia in Acre or elsewhere throughout the kingdom. The Pisan consuls can exact talia on the houses of Pisan burgenses situated outside the Pisan quarter [extra honorem Pisani communis] and the king cannot exact it; nor can he impose tersaria or any other dues [dricture] because of military or other needs. Guy and Sibylla concede to the Pisans the right to have a vicecomes or consul to run their curia in Acre, the right to place their own men in the catena, funda and gates of the city of Acre to look after Pisans and those who rent properties from them, who are to be free from any attempt by king’s men or those of any baro to tax them on entry and departure. The Pisans are to be free from charges on shipwreck and from any charge on houses, ovens, the bath house, casalia, mills and weights and measures [statera, et pensae et modia et mensurae] in Acre. The heirs of Pisans who die can recover their feoda and assisiae. The Pisans have the right to have their own churches and their liberties and Guy and Sibylla promise at assist them in any dispute with other churches in Acre. These concessions are to remain in force as long as the Pisans favour the rights of Guy and Sibylla and they will in future be freed from all servicia for the gifts that have been made to them. The Genoese are to have freedom of entry and departure with their merchandise throughout all the land overseas acquired by the king and his barones without the payment of any dues and in places that had been Christian the restoration of their goods and those of the church of St Laurence in Genoa. In every Muslim city the Genoese will have a fundicum, oven, bath house and ruga, in which a Genoese vicecomes will be established with full jurisdiction. They are promised security for their persons and goods. text: Feb. 13. Lateran. Pope Celestine III follows his predecessors Popes Honorius II, Innocent II, Celestine II, Lucius II, Eugenius III and Alexander III in taking Gaufridus prior and the canons of the Holy Sepulchre under protection. He renews their privileges and confirms their endowments. He states that in the absence of a patriarch the prior and canons will be responsible for managing the patriarchal house and familia. He confirms the freedom of prioral elections and the celebration by the prior of the stational Masses at the Templum Domini, Mt Sion, the Mt of Olives and St Mary of the Valley of Jehoshaphat in the absence of the patriarch. The prior and canons also have the right, in the patriarch’s absence, to excommunicate malefactors in their parishes, especially those who withhold the payment of tithes. None of their goods can be alienated or pledged, except by the common agreement, or that of the wiser part, of the canons; nor can anyone be sent overseas, suspended or expelled, unless his fault is manifest. Confratres can receive communion from the canons and be buried in the canons’ cemeteries unless they are excommunicated. The patriarch cannot extort goods from the canons and confratres. The canons are freed from payment of tithes on noval lands, cultivated by themselves or at their expense, or providing animal fodder. The pope also confirms half of the properties held in common with the patriarchate itself in England, Dacia, Germany, Poland, Ruthenia, Georgia [Auagia], Hungary and Constantinople.

He adds the following gifts: the right to take a rotula of sugar each day from the sugar press [masarium] in his casale called Fiergio for the needs of the sick in the hospital; in Casale Vmberti and his other casalia in the region of Acre the right to take each year 1 clicha of wheat and 1 clicha of barley from every worked carruca, to be provided by the rustici; 5 carrublae paid by the rustici for every 100 goats wintering in Aimery’s land, and 2 out of the 10 carrublae which Aimery levies for every 10 goats; 3 karrublae provided by the rustici for every carrucata owing Aimery 2 besants. Aimery confirms the eleemosynary gifts and old freedom [francisia] granted to the hospital in Cyprus by King Amalric.
