He confirms all possessions given to the Holy Sepulchre in his county by Count Raymond of St Gilles, Counts William Jordan, Bertrand and Pons, and all barones and others. Petrus Dominici Sepulcri prior records that when an inhabitant of Mahumeria, a woman called Odierda, became a consoror of the Holy Sepulchre, she gave the community a vineyard. When she died her son Andreas held on to it for a long time against the canons’ will. Robertus Nazarenus archiepiscopus, Fulcherius Tyrensis archiepiscopus, Bernardus Sydoniensis episcopus, Rorgo Ptolomaidensis episcopus, Helias of Tiberiadensis episcopus, Rogerius Ramathensis episcopus and others judged that the fruits of the vineyard should be enjoyed by the canons, but the canons, moved by charity, have remitted the fruits to Andreas and have conceded the vineyard to him for life on condition that they receive a third of the harvest and the tithe, and the vineyard itself on his death. In the presence of Patriarch Fulcher, Amalricus prior and the chapter of the Holy Sepulchre give Benscelinus and his wife Goda the house which Rogerius and Maria Sancti Lazari held of the Holy Sepulchre. The house is situated between the house[s] of Leodegarius molendinarius and the aforesaid Goda on the right side of the platea from which one goes to the Temple. Half the house will be held freely, the other half bearing a rent of 4 besants, to be paid annually to the Holy Sepulchre at Easter. That half will pass to the Holy Sepulchre on non-payment of rent for 15 days. Benscelinus and Goda can sell the property to anyone except the Templars and Hospitallers and other religious. In the case of a sale the Holy Sepulchre will exercise preemption rights, paying 1 silver marca less than the asking price. Amalricus gives the third part of the vineyard, which had belonged to him, to the decanus and brothers of the Holy Sepulchre, to which he adds whatever belonged to him in the vineyard of the Surianus Menferretus. The 2 pecię were next to the vineyard of the Holy Sepulchre on the eastern side. In return for this Hugo makes a counter-gift to Amalricus of 100 besants. Hugo, forced by the need to pay ransom for his release from captivity, sells the casalia, freed from all servitium dominium, for 3000 besants. Hugo’s brothers Balduinus and Barisanus, his mother Alois, his sister Hermengardis and his uncles Philippus de Neapoli, Guido Francigena and Henricus Bubalus, together with his relations [cognati] Philippus de Cafran and his brother, and Petrus de Teillei agree to the sale. On behalf of minors, Hugo’s sister Stephania and the heirs of Arrabit and his son Georgius, Hugo de Hybelino, his brother Balduinus, and Hugo’s homines, Muisse Arrabit and his son Georgius, Symon de Haia, Ordelet and his son Stephanus, Adam de Orgeol, Nicholaus de Hybelino, Hosmundus, his brother Radulfus, Lebertus, Paganus de Rohais and Philippus de Cafran swear to be guarantors and will go to the chapter of the Holy Sepulchre to confirm the sale within a year. In the presence of Patriarch Amalric [of Nesle] of Jerusalem, Arnaldus Sanctissimi Sepulcri prior and his convent give the men [homines] of Mahumeria the vineyards of domnus Hugo de Thorso and domnus Radulfus Parisiac[ensis] on the following conditions. Half of all fruits and a tithe are to be brought to the curia Sancti Sepulcri de Mahumeria or to whatever place in Mahumeria the dispensator Mahumerie ordains. Half the price achieved in any sale [must be surrendered to the Holy Sepulchre]. Sales to the Templars, the Hospitallers, any church, milites or to any that might harm the Holy Sepulchre are forbidden. If there is evidence of bad cultivation the dispensator Mahumerie, together with 4 or 5 witnesses, will give one warning and will then transfer the vineyard to another tenant, paying only half a marcha argenti for it. The planting of vines is allowed only on Holy Sepulchre land. If the canons wish to enlarge their village [villa], they can create mansiones on these vineyards. A. prior and the canons of the Holy Sepulchre receive Balduinus de Tornaco into confraternity, and promise to give him a prebenda, drawn on [the revenues of] either Jerusalem or Mahumeria and payable at Christmas, Easter, Pentecost, the feast of St Augustine and the feast of All Saints. Balduinus renounces claims he had unjustly made against the Holy Sepulchre over the inheritance of his brother Robertus Porcarius. He wills to the Holy Sepulchre that after his death the canons should have the quartus et decima of the vineyard, which is on the land [he has inherited from] R.
