[11] In the presence of Patriarch Amalric and dominus Constantinus Ramathensis episcopus, and with the consent of Abbot Herbertus and the brothers of the abbey of SS Joseph and Habakuk, Hugo de Ybelino Ramathensis dominus, makes an eleemosynary grant in return for the great sum of money [beneficium] provided by the canons of the Holy Sepulchre to achieve his liberation from captivity. He transfers to Nicholaus prior and the convent of the Holy Sepulchre Bethel and Beze, which is called Bazirim, with 2 carrucatę terrę, 5 jornatę terrę and a tower [turris], with whatever the abbey has built there, which at Bethel his father Barisanus had given in alms to the abbey of SS Joseph and Habakuk. In exchange for the return of this property Hugo had given SS Joseph and Habakuk part of the turonium which is below Mirabellum from which spring the surdi fontes and 2 carrucatę in the same territory, which the abbey can develop more conveniently than at Bethel. The church [ecclesia] the abbey constructed at Bethel was given to the prior and convent of the Holy Sepulchre on the orders of Patriarch A[malric] and at Hugo’s request. Now with the consent of his brothers Balduinus and Barisanus and his sisters Ermengardis and Stephania and with the advice of Philippus Neapolitanus he gives the property to his brothers the canons of the Holy Sepulchre, sealing with the seal of his grandfather [avus] Balduinus Ramathensis dominus. In the presence of Patriarch Amalric, Petrus Tyrensis archiepiscopus, together with his chapter, makes an eleemosynary grant, giving dominus Nicholaus Sancti Sepulcri prior and the convent of the Holy Sepulchre the entire tithe of a casale called Derina, which the canons possess. Any appurtenance of the casale which the canons acquire will be freed from the tithe. Petrus also gives the tithe of an enclosed viridarium between the wall and forewall of Tyre [inter murum et ejus antemurale], with a berquilium. He confirms their possession of the church of St Mary, which was the first cathedral of Tyre, saving the dignity of the mother church. This consisted of the entire tithe of a casale called Derina, which the canons possessed. Any dependency of the casale which the canons acquire would be freed from the tithe. Petrus also gave the tithe of an enclosed viridarium between the wall and forewall of Tyre [inter murum et ejus antemurale], with a berquilium. He now adds his grant of the tithe taken on 4 carruce terre, next to the casale of Derina, which had been given to the Holy Sepulchre by King Baldwin II. Pope Alexander III renews for Nicholaus prior and the canons of the Holy Sepulchre the papal protection granted them by his predecessors Popes Honorius II, Innocent II, Celestine II, Lucius II and Eugenius III and he confirms their possessions, referring specifically to confirmations by the patriarchs of Jerusalem of the grants of half of all oblations to the Holy Sepulchre; oblations to the relic of the True Cross, except on Good Friday and when the patriarch has need of them; the tithes of the city of Jerusalem and lands around, except for those from the funda; and the church of St Peter in Jaffa. He confirms the possessions and rights of the canons of the Holy Sepulchre in the Iberian peninsula [Yspania]. He exempts them from the payment of tithes on noval lands, cultivated by themselves or at their expense, and on animal fodder. He forbids the transfer of brothers from the community without the licence of prior and chapter.

[99] In return, the Holy Sepulchre makes a grant under seal, giving the Templars the 3 casalia of Bubin, Caphardin and Betelcanzir, with their lands and rustici, although the canons can retain any local rustici found elsewhere, so long as they are not living in the casalia.
