The Holy Sepulchre retains preemption rights. Petronilla will be provided by the Holy Sepulchre with the equivalent of the daily refectory rations of 4 men, but as a consoror of the Holy Sepulchre she remits 2 of these in an eleemosynary grant. text: 1158 - 1159. Arnaldus Dominici Sepulcri prior, with the agreement of his chapter, records exchanges made at Mahumeria with certain burgenses of the village [villa]. (1). An agreement made with Guibertus Papasius, with the consent of his wife Usanna, in which he exchanges the vineyard next to the cemetery and church of Mons Gaudii, inherited by Usanna, for a part [pars] at the far end [extrema pars] of the great vineyard that is next to the upper road [via superior] and adjoins another vineyard belonging to Guibertus on which he owes decima et terraticum. Tithes will be owed on Guibertus’s acquisition. [2]. An agreement with Gauterius Carpentarius, who exchanges a vineyard adjoining the one that had belonged to Guibertus Papasius for a vineyard in another part of the great vineyard, next to the high road [magna via], for which he will owe tithes. (3). An agreement with Ainardus Cavallom, who exchanges part of a vineyard, next to that which had belonged to Gauterius Carpentarius for another part of a vineyard in the great vineyard, this also being next to that of Gauterius Carpentarius. Tithes will be paid. Ainardus, impelled by poverty and having nothing with which to feed and bring up his wife and children, has sold this part to Martinus Carpentarius of Mons Gaudii for 26 besants with the consent of his lord and the court [curia]. (4). An agreement with the daughters of Pontius Faverius and their husbands. They exchange 30 jugera of cultivated land in the territory of Kalandria, owing decima et terraticum, for 2 petiae of a vineyard in valle Sancte Marie, one of 4 jugera, the other of 2 jugera, which had belonged to frater Petrus de Rametis, for which they will give tertia et decima. (5). The prior gives Stephanus Pastinace the vineyard that had belonged to frater Arnaldus on condition that he cultivates the wasteland and pays medietas et decima annually. (6) An agreement made with Helyas and Amicus, his relation [gener], in which they exchange part of their garden which is next to the berquilium, for a pars of uncultivated land that had come to the canons in their agreement with Robertus de Retest and adjoins land belonging to Helyas. (7). An agreement with the hospitale at Mahumeria in which the hospitale exchanges part of a garden that stretches between the berquilia of the Holy Sepulchre and the hospitale for 2 jugera of the vineyard that had belonged to frater Stephanus Ortalis. Tithe will be owed for this. (8). Frater Robertus Porcarius gave himself and all his possessions to the Holy Sepulchre [on becoming a confrater]. This was confirmed at Mahumeria by domnus A. prior, assisted by the burgenses of the village [villa] in plenarie curie, to whom Robertus handed a staff [baculum], giving everything to the Holy Sepulchre. Robertus enumerated his possessions, specifying land next to that of Robertus Ungarus, which had been given by Prior Giraldus to him and his wife, previously married to Umbertus, but which he had abandoned because he had not been able to cultivate it; some adjoining land given by Prior Petrus, who later became archbishop of Tyre, to Robertus in an exchange for land he had bought from Galterius Bela; and land nearby which Prior P. had given and on which was owed terraticum et decimam. (9). Prior Arnaldus and domnus Robertus de Retest came to Mahumeria and agreed on the boundaries of their respective territories. They chose an elderly Sarracenus called Pes Tortus, a homo rusticus of Robertus, to provide evidence of the boundary. This survey took place in the presence of the following canons of the Holy Sepulchre: domnus Petrus elemosinarius; domnus Bernardus Antiochenus; frater Pisanus; Petrus Judaeus; Johannes interpres; Arbertus; Stephanus. The son of the aforesaid Robertus [de Retest] was also present.

Raymond III comes Tripolitanus records under seal his arbitration in a dispute between on one side Bernardus abbas Montis Thabor and on the other Petrus de Nimenes and his brother of the same name. Agreement was reached in the house of Giraldus de Conilz in Acre. Bernardus, together with the chapter of Mt Tabor sold the lease to whatever the abbey had in the neighbourhood of the city of Tripoli, a casale called Betahmum situated in the territory of Mont Pèlerin and everything else it possessed in the county of Tripoli to Petrus de Nimenes and his brother for 25 years. Petrus de Nimenes and his brother had to make a down payment of 900 besants and provide an annual census of 100 Saracen besants, payable at Easter. After 25 years the casale and the other properties would revert to the abbey, irrespective of any improvements that had been made to them. The brothers could alienate the properties by sale, pledge or gift within the 25 years, provided they were not granted to any religious community or secular knights [milites] and the abbey continued to enjoy the census. The abbey will have preemption rights. If the Muslims [hostes Crucis Christi] should destroy the houses, olive trees or vineyards, the brothers would be absolved paying rent until they could do so. Baldwin, per dei gratiam in sancta civitate Ierusalem Latinorum rex sextus, confirms by sealed charter the concession in the royal curia in Acre made by Rohardus, with the agreement of his wife Delina, of the drugomanagia of the casalia of Cabur, Tyron and Coket to Barutus and his heirs. The drugomanagia had been given to Barutus by Ivetta, the grandmother of Rohardus, and by her son Petrus Filiolus. Barutus has given Rohardus 225 besants and has paid homage [hominium fecisti] for the drugomanagia. He will receive from every villanus in the casalia 1 modius of wheat and 1 modius of barley for every carrucata that is individually worked; and with respect for each carrucata held in common by the lord [domnus] and the villani, 2 manipuli of wheat and 2 manipuli of barley from the harvest [annona]. When he visits one of the casalia the villani will provide victuals for him and his horse. When he travels outside the casalia with his lord, the latter will provide only for his horse. If he loses the horse in the service of his lord [in servitio domni] the latter will give him 15 besants. For every 100 modii harvested [de annona] communally by the lord and villani, Barutus will receive 6 modii, or less in proportion to the harvest. Egidii comitissa, is admitted in common chapter by magister R. de Molinis as a consoror of the Hospital of St John of Jerusalem. She chooses to be buried in the Order’s cemetery. She makes a sealed eleemosynary gift to the Hospital and the poor of the casale of Betheras on the plain of Ascalon, which she had bought with all its rights. She imposes the condition that while she remains in the East the Order will give her 500 besants a year, payable on the Feast of the Assumption of the Blessed Virgin Mary. If she should return to the West, the Order will provide her, in place of the 500 besants, with 12 and half marks in unadulterated silver of Troyes weight, payable each Pentecost in the Hospital’s chapter, meeting at Quierzy [Ceresers] or elsewhere. After her death the Order will bury her as a consoror and commemorate her obit every year. text: Apr. 20. Acre. Iacobus de Amigdala records under seal that he has come to an agreement with the magister and convent of the Hospital of St Mary of the Germans. He accepts an annual rent of 6400 Saracen besants, which the emperor Frederick, king of Jerusalem and Sicily, gave the Order, in exchange for his feudum, which came to him by legitimate succession through his mother, the daughter of comes Iozcelinus. Among the casalia in his fief is Mobilir, given to him in exchange for Trefile and castrum novum, called Montfort, which the Order is now fortifying, and for a garden and a mill that are dependencies of Trefile. Other casalia are: Ialim, Tharbucha, Tarbosta, Suru, Beauer, Camesru, Tetramme, Fennes, Tersias, Ianot/Ianoth with a dependent gastina called Hemelie, Getz, Cabbara with a gastina called Camesie, Iunite, Blutun and Castrum Regis. Excluded from the sale are those possessions the Order held at Castrum Regis before they acquired the lordship and everything it bought or received in eleemosynary grants. Iacobus and his heirs will receive the rent from the revenues of the cathena and funda of Acre, payable in 4 instalments of 1600 besants. If the rent should fail magister Hermannus and his successors and the Order are held to pay Iacobus and his heirs 3200 Saracen besants within 6 months or they will restore the entire feudum to Iacobus, except for the castle of Montfort, because the site was given in exchange for Mobilie. This agreement will be enforced by the High Court [curia regis]. If the 3200 besants are not paid within 20 days tthe Order will pledge the casalia of Erchat, Saphet and Ancre. If at the end of six months the debt is still not paid, Iacobus and his heirs can dispose of these 3 casalia as they wish.
