[43] When Petrus Sancti Lazari, a confrater [frater] of the church of the Holy Sepulchre, died, his daughter, who was a minor, and her mother asked to be able to hold the feodum of Sancti Lazari for their sustenance until the daughter should marry, after which the service owed for the fief would be resumed. When the daughter reached marriageable age the canons wanted to marry her to their famulus Petrus, whom they had brought up [noster nutritus]. The mother was vehemently opposed although she did not want to lose the fief in her lifetime. Brought with her mother, step-father [victricus], male protectors [patrini] and other lay people before Patriarch Stephen and the canons in chapter, the daughter stated that she would rather beg than marry against her mother’s will. She returned the fief to the canons on condition that her mother and step-father should continue to enjoy it for their lives. W[illelmus], third prior of the church of the Holy Sepulchre, records the canons’ agreement and their decision to provide for the son of the mother and her husband after their death. Witnesses: Anselmus cantor; Ato; Gislebertus; Petrus Bernardi; Gaudencius; Petrus elemosinarius; Aimericus; Gaufridus Acus; Petrus de Vendosme; Berengarius Parvus. Patriarch Stephen seals the deed.

Patriarch Eraclius of Jerusalem and P. sanctae resurrectionis ecclesiae prior, together with the chapter of the Holy Sepulchre, write under seal to Conradus de Dachavv Dux [Count Conrad III of Dachau], reminding him how, when he had been on pilgrimage to Jerusalem, he was told that in the time of his father his men had murdered a canon. In recompense he had promised to build a church in honour of the Cross. He should also help restore properties lost by the canons.

text: Dec. 25 1197 - Dec. 24 1198. Patriarch [Aymar] Monachus of Jerusalem and the chapter of the Holy Sepuchre write to all the faithful, clergy and laity, in the duchy of Poland. They recount how the late dominus Iaczo visited the church of the Holy Sepulchre and asked that canons should return with him to Poland. A canon went back with him. With the agreement of the dukes, the canons of the Holy Sepulchre were given many properties and liberties, which are listed. They appeal for more alms-giving.

text: Aug. 19. Orvieto. At the request of the prior and brothers of the Holy Sepulchre, Pope Honorius III takes their church and its possessions under papal protection. He refers especially to churches of the Holy Sepulchre at Acre, Tyre and Antioch, and those in the Latin empire, southern Italy, Sicily, Iberia, Poland, Bohemia, Hungary, Croatia [Sclavonia], Germany, France, Lombardy, Tuscany and England; and to tenements [tenimenta] at Tripoli and Gibelech, and a casale on Cyprus, together with a possession in Moravia. He confirms liberties acquired before the Fourth Lateran Council; the right to obtain chrism and holy oils from Latin diocesan bishops, or even from others; the ban on any brother leaving the community without licence from the patriarch or the prior; and freedom from the consequences of interdict.
