text: Feb. 26. Acre. Baldwin, per gratiam dei in sancta Ierusalem Latinorum rex quartus, confirms under seal the agreement made on his orders by Girardus de Valentia with the Latins [Latini] newly established in Casale Huberti de Paci. Girardus has given the colonists [incolae], who he has placed there, houses to be held by hereditary right. The Latins will render to King Baldwin a 7th part of the harvest of the land [fructus terre] which has been assigned to them to work, keeping 6 parts for themselves. They will render to the king a 15th part of the bread baked in the oven, and a 10th part of anything else cooked there. Whenever they bathe in the bath house they will each pay half a denarius. They will pay 1 denarius as a weights and measures tax [pro mensuratione] for each besant’s worth [bisantiata] of whatever they buy in relation to the casale. They can sell bread, wine, meat and other things in Acre without paying any dues. They can use the mill of Ferge 3 days and nights each week, saving royal rights. The cultivators of vineyards and gardens, which Giraldus de Valentia leases out on the king’s behalf for periods of time will render the king a fourth part of the fruits, keeping 3 parts for themselves, and the tenants of olive groves, assigned each a part by Giraldus, will collectively render two-thirds of the fruits to the king, keeping a third part for themselves. Sales of houses and lands in the casale will be respected, but in every sale 1 carrupla in the besant will go to the king. text: May 10. Antioch. In the palatium. Rainald [of Châtillon], Dei gratia Antiochenorum princeps, together with Constantia eorumdem principissa, gives the church of St Mary and the archbishop of the city of Pisa, together with all the people from the province of Pisa living in Antioch, represented by their legate Butato, land on which to build a house in the port of Latakia. This land extends below the church of S. Helias, [running] before the houses of the Temple and of magister Ugo to the sea, and along the beach as far as a tannery [teneria] and the old wall and as far as the ditch. If by the judgement of a court the Pisans can recover land in the port that Willelmus Embriacus has occupied, the land described above will be restored to the prince. Rainald also gives the Pisans a house in Antioch, which had belonged to dominus Odo de Tyro. He remits half of all duties levied on Pisan imports and exports, sales and purchases. He assures the Pisans of his protection. The Pisans’ goods will be safeguarded in shipwrecks and the possessions of those who die in the principality will be returned to their relations intact. The Pisans may settle disputes among themselves in their own court, but if any dispute arises with one of the prince’s subjects the case will be dealt with in his court. The charter, fortified with the prince’s seal, was drawn up by Gaufridus cancellarius principis. text: Nov. 2. Acre. Baldwin, per gratiam dei in sancta Hierusalem Latinorum rex quartus, with the advice and agreement of his mother Queen Melisende, seals a peace treaty with the Pisans, who renounce all the claims on confiscated goods that they have brought against him and his homines, except for those relating to their honores that they are pursuing against the patriarch of Jerusalem, the clergy [clericatus] of Caesarea and the abbot and monks of St Mary of the Latins. The king, on his behalf and on that of his homines, renounces all claims and confiscations made against the Pisans. The Pisans promise to keep security and faith [salvum et fidum] with the king. They will protect him and his subjects homines by sea and land and will do their best to prevent other persons harming them. The king makes the same promise of security, protection and faith to the Pisans. King Baldwin excludes from this agreement the sale in Egypt of iron, wood, pitch, [pix] or arms, which can be confiscated without breaching the treaty. The king gives the Pisans a viscounty in Tyre, the holder of which can judge the Pisans in their own court [curia], reserving only to royal justice cases involving death sentences [traditio mortis]. He gives the Pisans 5 carrucate of good land next to Tyre and an oven in Tyre. He confirms King Baldwin II’s grant to the Pisans of 5 houses in the ruga next to the port of Tyre free of rent [tributum vel redditum] and freedom from taxes on their shipping [naves] and goods in the port, although pilgrims and other men (who are not Pisan merchants) would not be exempt. The goods of Pisans who died would not be subject to any restrictions or taxation. Baldwin wishes his brother Amalricus comes Ascalonitanus to make peace with the Pisans. text: Dec. 25 1156 - Nov. 20 1157. In the presence of Queen Melisende, agreement is reached on an exchange between the Hospital of St John of Jerusalem and Joeta abbatissa S. Lazari Betanie. Raimundus magister Hospitalis, with the consent of all the brothers of his chapter, cleric or lay, gives the abbess and nuns of St Lazarus all the tithe the Hospital had in the casale of Bethaanina in exchange for a vineyard that is bordered on the east by a vineyard belonging to the Hospital, on the south by a vineyard belonging to St. Anne, on the north by the road that goes to Nablus as far as the crossroads [bivium] of S. Stephanus. The vineyard is granted by Joeta with the consent of all the nuns and chapter of St Lazarus. Avis abbatissa Sancte Marie Grandis, with the consent of her nuns, in particular Odulina, Sole [Solis] and Gaudelena, grants the Hospital of St John half the tithe she took on the vineyard, in the presence of Petrus de Sancto Lazaro, Lambertus Cambiator and Stephanus Umbertus. Sebilia abbatissa Sancte Anne, with the consent of Ermengardis and Gilia and her other nuns, grants the Hospital the other half the tithe she took on the vineyard, in the presence of Radulfus de Sancto Petro, Willelmus Ebraldi and Amisarnus Carnifex. In the presence of Patriarch Amalric [of Nesle] of Jerusalem, Arnaldus Sanctissimi Sepulcri prior and his convent give the men [homines] of Mahumeria the vineyards of domnus Hugo de Thorso and domnus Radulfus Parisiac[ensis] on the following conditions. Half of all fruits and a tithe are to be brought to the curia Sancti Sepulcri de Mahumeria or to whatever place in Mahumeria the dispensator Mahumerie ordains. Half the price achieved in any sale [must be surrendered to the Holy Sepulchre]. Sales to the Templars, the Hospitallers, any church, milites or to any that might harm the Holy Sepulchre are forbidden. If there is evidence of bad cultivation the dispensator Mahumerie, together with 4 or 5 witnesses, will give one warning and will then transfer the vineyard to another tenant, paying only half a marcha argenti for it. The planting of vines is allowed only on Holy Sepulchre land. If the canons wish to enlarge their village [villa], they can create mansiones on these vineyards. text: 1158 - 1159. Arnaldus Dominici Sepulcri prior, with the agreement of his chapter, records exchanges made at Mahumeria with certain burgenses of the village [villa]. (1). An agreement made with Guibertus Papasius, with the consent of his wife Usanna, in which he exchanges the vineyard next to the cemetery and church of Mons Gaudii, inherited by Usanna, for a part [pars] at the far end [extrema pars] of the great vineyard that is next to the upper road [via superior] and adjoins another vineyard belonging to Guibertus on which he owes decima et terraticum. Tithes will be owed on Guibertus’s acquisition. [2]. An agreement with Gauterius Carpentarius, who exchanges a vineyard adjoining the one that had belonged to Guibertus Papasius for a vineyard in another part of the great vineyard, next to the high road [magna via], for which he will owe tithes. (3). An agreement with Ainardus Cavallom, who exchanges part of a vineyard, next to that which had belonged to Gauterius Carpentarius for another part of a vineyard in the great vineyard, this also being next to that of Gauterius Carpentarius. Tithes will be paid. Ainardus, impelled by poverty and having nothing with which to feed and bring up his wife and children, has sold this part to Martinus Carpentarius of Mons Gaudii for 26 besants with the consent of his lord and the court [curia]. (4). An agreement with the daughters of Pontius Faverius and their husbands. They exchange 30 jugera of cultivated land in the territory of Kalandria, owing decima et terraticum, for 2 petiae of a vineyard in valle Sancte Marie, one of 4 jugera, the other of 2 jugera, which had belonged to frater Petrus de Rametis, for which they will give tertia et decima. (5). The prior gives Stephanus Pastinace the vineyard that had belonged to frater Arnaldus on condition that he cultivates the wasteland and pays medietas et decima annually. (6) An agreement made with Helyas and Amicus, his relation [gener], in which they exchange part of their garden which is next to the berquilium, for a pars of uncultivated land that had come to the canons in their agreement with Robertus de Retest and adjoins land belonging to Helyas. (7). An agreement with the hospitale at Mahumeria in which the hospitale exchanges part of a garden that stretches between the berquilia of the Holy Sepulchre and the hospitale for 2 jugera of the vineyard that had belonged to frater Stephanus Ortalis. Tithe will be owed for this. (8). Frater Robertus Porcarius gave himself and all his possessions to the Holy Sepulchre [on becoming a confrater]. This was confirmed at Mahumeria by domnus A. prior, assisted by the burgenses of the village [villa] in plenarie curie, to whom Robertus handed a staff [baculum], giving everything to the Holy Sepulchre. Robertus enumerated his possessions, specifying land next to that of Robertus Ungarus, which had been given by Prior Giraldus to him and his wife, previously married to Umbertus, but which he had abandoned because he had not been able to cultivate it; some adjoining land given by Prior Petrus, who later became archbishop of Tyre, to Robertus in an exchange for land he had bought from Galterius Bela; and land nearby which Prior P. had given and on which was owed terraticum et decimam. (9). Prior Arnaldus and domnus Robertus de Retest came to Mahumeria and agreed on the boundaries of their respective territories. They chose an elderly Sarracenus called Pes Tortus, a homo rusticus of Robertus, to provide evidence of the boundary. This survey took place in the presence of the following canons of the Holy Sepulchre: domnus Petrus elemosinarius; domnus Bernardus Antiochenus; frater Pisanus; Petrus Judaeus; Johannes interpres; Arbertus; Stephanus. The son of the aforesaid Robertus [de Retest] was also present.

The canons of the Holy Sepulchre come to an agreement with Robertus de Retesta, who had challenged the boundary of the land of Birra, which is now called Mahumeria and is contiguous to his casale called Salome. The prior and canons call witnesses who authenticate the boundary drawn for King Baldwin I when he gave that land to them. They allow Robertus to employ the burgenses of Birra to cultivate his lands, which produce grain, oil, vegetables, and have vines and trees. The tithes owed by the burgenses - otherwise owed to the canons - will be reserved to Robertus with respect to his lands, and he will pay these tithes to his lords. The burgenses will have no authority to infringe the rights of Robertus. text: Mar. 16. During the siege of Blahasent/Belhasam [Qal‘at Abu’l-Hassan]. Baldwin, per dei gratiam in sancta civitate Iherusalem Latinorum rex, with the agreement of his wife Theodora Iherosolimorum regina and his brother Amalricus comes Ascalonitanus, confirms under seal an agreement with Rainaldus Falconarius. Rainaldus allows the king to create as many canals as he likes to draw off water from the River of Acre, called Belus, to irrigate his sugar cane plantations. In return the king will give Rainaldus one fifth of the profits from the sale of sugar, after expenses have been deducted. The king permits Rainaldus to exact the same dues [talis exactio et talis consuetudo] from all mills inside and outside Acre as he took formerly from his mills on the River Belus. He promises Rainaldus and his wife domina Luciana, that his heirs will have the same rights.
