Baldwin, secundus dei gratia rex Iherusalem/dei gratia secundus Latinorum rex Iherosolimitanus, responding to the request of Patriarch Warmund and the clergy and people of Jerusalem, and with the assent of his optimates makes a sealed eleemosynary grant, remitting the customs duty [consuetudines] which has been exacted at the gate of the city from those bringing in grain, hay and vegetables, because this has caused hardship to both pilgrims visiting the Holy Sepulchre and the residents of the city. Baldwin absolves from any exaction all those, whether Muslim [Sarraceni] or Christian, who bring grain or hay, beans, lentils and chickpeas through the gates of Jerusalem. They are to have the freedom to enter and leave and to sell where and to whomsoever they want. Baldwin also remits half of (other) customs duties (consuetudinaria). With the assent of King Baldwin II and his wife Emma, Hugues comte de Joppe makes a sealed eleemosynary gift to the abbey of St Mary of the Valley of Jehoshaphat, built over the tomb of the Blessed Virgin Mary, represented by Abbot Gelduin, his uncle [patruus]. He gives a third good casale, called Machoz, situated in the territory of Ascalon, in addition to the 2 others he has already given. He also gives: a good mahomeria in the city of Ascalon; a verger outside the city, chosen from among the better ones; a casale inhabited by Samaritans called Saphe in the territory of Nablus; a gastina called Melbena and some land before the gate of Jaffa that previously belonged to Framericus. Constantius Sancte Quarantene servus confirms that after the death of Eustachius Granerius he and his brothers reminded his widow Ema of the grant to the community in 1116 of the use of water for 24 hours each fortnight. They asked for the water right to be increased to once a week. With the agreement of her sons, Eustachius and Galterius, together with her husband Hugo princeps Joppe, Ema makes an eleemosynary grant, giving the community the use of the water for 24 hours every Saturday. The territory of the casale, situated on the hillside, comprises 4 carrucates [tantum terrᶒ, quantum quatuor paria boum poterunt excolere de anno ad annum]. Baldwin excludes from the confirmation another unnamed casale, on which he recognizes the Holy Sepulchre has claims, and a garden [ortus] situated between the sea wall and sea forewall of the city. Bernardus ecclesie Tripolitane episcopus and the canons of his church reach an agreement with Raymundus pater Iherusalem Xenodochii, through the judgement of Pons episcopus Podiensis, abbas S. Felicis de Gerunda and Petrus de Podii Laurentii. Raymundus had shown the bishop charters of gift made by Count Raymond [of St Gilles], and Arbertus episcopus and Pons episcopus, and confirmed in papal bulls of privilege. Bernardus makes an eleemosynary grant, giving Raymundus Hospitalis pater and his brothers the tithes of all the property the Hospitallers own in the diocese of Tripoli, except for half the tithes returned in the parish of Artussia, together with the tithes of the mills of Guillelmus Berardi. The Hospital is to retain the tithes of the bishopric of Archae as long as it has possession of the church there.
