text: †Sept. 23. Jerusalem. Baldwin, per gratia dei in sancta civitate Iherusalem Latinorum rex quartus, gives the commune of Marseille under seal a church, oven and rua in Jerusalem, Acre and all the ports of his kingdom, together with freedom to enter and leave, buy and sell without paying dues. He gives this in recognition of the assistance rendered by the commune in the taking of the territories of Jerusalem and Tripoli. In return for the contribution of 3,000 besants made by the commune to the capture of Ascalon and Jaffa, King Baldwin gives Marseille a casale [casellium] on the boundary between Ascalon and Jaffa called Ramie with all its rustici and animals. The king’s gift is reinforced by the promise of the papal legate, Patriarch G. of Jerusalem, Radulfus episcopus Bethleem and all the bishops to excommunicate all who would challenge it. Baldwin, per gratiam dei in sancta Hierusalem Latinorum rex quartus, with the advice and agreement of his mother Queen Melisende, seals a peace treaty with the Pisans, who renounce all the claims on confiscated goods that they have brought against him and his homines, except for those relating to their honores that they are pursuing against the patriarch of Jerusalem, the clergy [clericatus] of Caesarea and the abbot and monks of St Mary of the Latins. The king, on his behalf and on that of his homines, renounces all claims and confiscations made against the Pisans. The Pisans promise to keep security and faith [salvum et fidum] with the king. They will protect him and his subjects homines by sea and land and will do their best to prevent other persons harming them. The king makes the same promise of security, protection and faith to the Pisans. King Baldwin excludes from this agreement the sale in Egypt of iron, wood, pitch, [pix] or arms, which can be confiscated without breaching the treaty. The king gives the Pisans a viscounty in Tyre, the holder of which can judge the Pisans in their own court [curia], reserving only to royal justice cases involving death sentences [traditio mortis]. He gives the Pisans 5 carrucate of good land next to Tyre and an oven in Tyre. He confirms King Baldwin II’s grant to the Pisans of 5 houses in the ruga next to the port of Tyre free of rent [tributum vel redditum] and freedom from taxes on their shipping [naves] and goods in the port, although pilgrims and other men (who are not Pisan merchants) would not be exempt. The goods of Pisans who died would not be subject to any restrictions or taxation. Baldwin wishes his brother Amalricus comes Ascalonitanus to make peace with the Pisans. With the agreement of his son Humfredus and his daughters, and of Gualterius Berythensis, in whose feodum it had been, and of Gualterius’s brothers Guido and Bernard, Humfredus de Torono gave half of the castellum of Paneas. Humfredus also gave the Hospital half of Castellum Novum, houses belonging to domna Albereha de Torono, 2 vineyards in the territory of Toron, which Guido de Scandalione had given, and a hospitale in Toron. King Baldwin III gives Jozelinus Pesellus and his heirs a fief-rent of 1,200 Saracen besants, to be taken from the cathena Acconensi in return for the servitium of 2 milites, and promises the first feodum in his kingdom owing 20 milites or, if Jozelinus and his heirs prefer, a smaller feodum that will come into his hands. On reception of that feodum the fief-rent of 1,200 besants will revert to the king. Baldwin promises a feodum of 100 milites in Egypt, when that land falls to him. He also gives a further fief-rent of 600 besants a year, to be taken in 4 instalments, from the funda Acconensi, in return for the service of 1 miles.

The names of the inhabited dependencies are Capharseme, Benna, Carcara, Ialin, Balaton, Torsia, Aithire, Tabaria, Iazon. If the king disposes of any of these, Iohannes will be compensated to the value of a horse. In the exercise of his office, Iohannes will have the same rights of procuration for himself and his horses as has the king when on expedition or with his army. Baldwin, per gratiam dei in sancta Hierusalem Latinorum rex quartus, with the agreement of Theodora, illustris Hierosolimorum regina, his brother Amalricus comes Ascalonitanus, Count Raymond III of Tripoli, domna Melisende, Raymond’s sister and the future empress of Constantinople, her mother and King Baldwin’s maternal aunt domna Hodierna Tripolitana comitissa, and all those concerned, gives under seal to Philipus Neapolitanus and his heirs in perpetuity Mons Regalis, Crach castellum and Ahamanh with all their dependencies, land and honor, covering an area stretching from Zerca to the Red Sea [Mare Rubrum] and even beyond, which had been held by Paganus pincerna regius in his lifetime. The king also gives castellum Vallis Moysis with all the land in Transjordan [trans fluvium Iordanem] with all its villanni, Suriani or Sarraceni, on either side of the River Jordan held by Balduinus, the son of Hulricus vicecomes Neapolitanus, which Hulricus had held in his lifetime before Balduinus. The king had obtained this in an exchange with Balduinus, although excluded from the exchange were the villanni settled by Balduinus ‘ad ignem et ad focum hospitatos locatos et manentes’ on the day the agreements were made. The king transfers to Philippus the fief held in-chief across the River Jordan that Iohannes Gomannus held, together with the servicium previously owed to the king. Henceforward Iohannes Gomannus will owe hominium and servicium to Philippus. The gift is made, ‘salve regie maiestati servicio’. Philippus will hold all future conquests of the king. Excluded from the gift are all the king’s Beduini who were not born in the land of Mons Regalis and all caravans [caravani] crossing the territory on journeys between Alexandria or Egypt and Baghdad [Baldach]. In return Philippus, with the agreement of his wife Helisabet, his son Reynerius and his daughters, his brothers Guido Francigena and Henricus Bubalus, gives the king in exchange the entire feudum that came to him from domnus Rohardus and his wife domna Gisla, which Rohardus and Gisla had held for a year and a day, except for a casale called Adelemia and whatever he has in Montanis Bassis. Philippus gives the king the entire feudum of his father Guido de Mile, which Guido de Mile and Philippus held for a year and a day. Philippus gives the king the feudum in montanis Neapolitanis of Guido Francigena, which Guido held from domnus Rohardus and afterwards from Philippus himself, the feudum of Henricus Bubalus his brother and the feudum of Gaufridus Tortus together with Maron and all that Philippus had in lordship [dominium] in the mountains of Tyre and Toron.
