text: Sept. 1 - Dec. 24. Hugo Cesaree Palestine dominus, with the agreement of his wife Ysabel and the advice of his probi homines, makes a sealed grant to Petrus prior and the Latin canons of the Holy Sepulchre. He gives them the mountain next to the garden of Feissa, where rise the waters that feed the aqueduct. The land stretches from the road that comes from Braicaet towards the Casale Sancti Sepulcri, eastwards, by way of the cavea which is between two hills and the river bed [torrens] that flows in winter, to a small hill situated between the said mountain and the mountain of Broiquet; and from the bed of the river bed towards the aforesaid small hill along the side [per crepidinem] of the small hill, as designated by crosses, towards a hillock [monticulum], called the lime kiln [calcis fornax], and then to the south to another hillock, which is not far away, which was the old lime kiln [calcis fornax], extending along the side of the hill in a straight line to a wall [spina] on the plain, which divides the casale of Faisse, belonging to the Holy Sepulchre, from the casale of Sabarim, belonging to the Hospital. The boundaries were drawn by the canons of the Holy Sepulchre with Georgius and his son Balduinus. Hugo retains the right to repair the old aqueduct and the spring that feeds it, in order to convey water to his sugar cane plantation at Casale Bubalorum. In return for this he will provide the canons with half a quintala [of sugar] each year from a sugar cane press [macera], and if there is a surfeit [amplius] he will provide a whole quintala. He can construct another aqueduct and dig another spring to lead water to the aforesaid casale. Hugo also confirms the gift made by his grandfather Eustachius Granerii and his father Galterius, with the boundaries that were established. He adds the privilege that the canons can sell or buy, weigh and measure and transport by land or sea without any payment of usaticum or exactio throughout his land, within and outside the city of Caesarea. The canons give Hugo 400 besants in return for the gift and confirmation. [125] Bohemond III, the son of Prince Raymond, Dei gratia princeps Antiochenus, with the agreement of his wife domina Orgollosa principissa, confirms under seal for the church of St Mary, the archbishop, consuls, senators and members of the commune of Pisa and its province residing in his principality land to build a house in the port of Latakia. This land extends below the church of St Elyas, before the house of the Templars [domus Templi] and the house of magister Ugo, as far as the sea, and along the seashore as far as a tannery [taneria] and the old wall, and in the upper part as far as the ditch. If the Pisans by the judgement of court [iudicium curie] can recover the land in the port occupied by Hugo Embriacus, the son of Willelmus, the land now given will revert to the prince. Bohemond gives in addition a house in the city of Antioch that belonged to dominus Odo de Tyro. He assures the Pisans of the security of their persons and goods in case of shipwreck and of the property of those who should die, except when they are intestate. He remits half of all taxes [medietas totius iuris] customarily paid on entry and departure, coming and returning, buying and selling, throughout his territory and he assures them of his protection. Disputes between them can be settled in their own court [curia], but if a case cannot be decided, or involves theft, predation, homicide or the subjects of Antioch, it will decided in the prince’s court. The platea stretches from the port to the public way [via publica], having on one side the house of Martinus Piper and on the other the house of Willelmus Ioppensis. The Pisans can construct vaults [voltae] on the platea, over which they can build whatever they wish. Below the vaults the platea remains in the hands of the Pisan commune [commune Pisanorum] and open to the city [in civitatis servitium]. Iohannes de Ybelino domnus Beriti et regni Ierosolimitani baiulus records how Iohannes Tortus came into his presence, and that of the High Court [regalis curia] and asked of Iohannes de Ybelino and the vassals [homines] of the Lady Maria, regni honorabilis domna, licence to sell his house in Acre to settle his debts. After taking counsel from the vassals of the Lady [Maria], Iohannes de Ybelino judged that the licence could not be granted. On the response of Iohannes Tortus that he would have to sell either his fief [feodum] or his house to pay his debts, the court decided to change its decision and permit Iohannes Tortus to sell his house in order to retain his fief. And so, in the presence of the baiulus Iohannes de Ybelino, who sealed the charter, and of the High Court [regalis curia] and with the agreement of Maria, the wife of Iohannes Tortus, his sister Beatrix and her husband Willelmus de Monliart, Iohannes Tortus sold his house to the Hospital of St Mary of the Germans in Acre for 2700 Saracen besants. The house is bordered on the east by the houses of Mt Tabor and of Beloais, the royal way [via regia] and the houses that belonged to Petrus Bordin, on the west, by the house of Bonefrage filius Sahit, the rua Judeorum, the house of the Jews and the stable [stabulum] of Renerius scriptor, on the north by the house of Maria, the wife of the late priest of the church of St Mary Magdalene, and on the south by the royal way [via regia] and the house held by domna Hauhis of Iohannes Tortus. In return for her agreement to the surrender of this house, the brothers of the Hospital of St Mary have given Hauhis 300 Saracen besants and 2 marchae argenti. The Lady Maria has had 200 besants from the brothers of the Hospital for her agreement to the sale.
